Information requested

“The advice provided by Marine Scotland to OPRED and/or the Secretary of State for DESNZ concerning the Rosebank Development.

The advice (if any) provided by Marine Scotland to the North Sea Transitional Authority (legally known as the Oil and Gas Authority) concerning the Rosebank Development.

Any further comments or documents provided by Marine Scotland to OPRED and/or the Secretary of State for DESNZ concerning the Rosebank Development.”

Response

I enclose a copy of all of the information you requested.

To provide more context, we have included in the scope of the request any final evidence, reports or documentation regarding the Rosebank Field produced and sent by Marine Directorate to any team of OPRED or DESNZ that could be involved in the decision making process as it is unlikely that colleagues in Marine Directorate would have contacted the Secretary of State directly in this matter. In addition, the UK Government department responsible for liaising and regulating the oil and gas industry has had numerous name changes. The government departments responsible have included the Department for Trade and Industry (DTI), Department for Energy and Climate Change (DECC), Department for Business Energy and Industry Strategy (BEIS) and now the Department for Energy Security and Net Zero (DESNZ). The current regulators are separate authorities, the North Sea Transition Authority (responsible for the licensing process) and the Offshore Petroleum Regulator for Environment and Decommissioning (responsible for the permitting system). We have included information sent to any of the above mentioned departments.

An exception under regulation 11(2) of the EIRs (personal information) applies to some the information requested because it is personal data of a third party and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exception is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exception.
