Step Four – Assessment

Does your assessment identify any unique impacts on island communities?

31. No. The order of priority of distribution of the estate, including interest payable on creditors’ claims, is laid out in the 2016 Act and applies to all bankruptcy cases irrespective of the location of the party who is bankrupt or of their creditors. We do not consider therefore that the amendment will differently affect or impact those on island communities.

32. The potential impacts outlined in this document are not unique to island communities and may also be faced by rural communities across mainland Scotland, nor have they been raised through the public consultations or by the stakeholder-led working group.

Does your assessment identify any potential barriers or wider impacts?

33. We do not consider there to be any potential barriers.

How will you address these?

34. Given the foregoing, in our opinion, we do not consider that this instrument will have an effect on an island community which is significantly different from its effect on other communities (including other island communities).
