Can I please request the calibration data, calibration method, testing data and testing methods for the HADECS system prior to its live operation?

Transport Scotland does not have the information you have asked for because all calibration certificates associated with safety cameras deployed in Scotland through the Scottish Safety Camera Programme are held by Police Scotland.

This is a formal notice under section 17(1) of FOISA that Transport Scotland does not have the information you have requested.

Calibration method

Transport Scotland does not have the information you have asked for because all equipment, including associated calibration methods, deployed in Scotland through the Scottish Safety Camera Programme is subject to Home Office Type Approval (HOTA). All equipment is thoroughly tested and HOTA provides an assurance of the technical accuracy and reliability of all approved devices. The supplier of the M90 HADECS camera system is SWARCO UK & Ireland Ltd.

This is a formal notice under section 17(1) of FOISA that Transport Scotland does not have the information you have requested.

Testing data and testing methods

Please see Annex A to this response for details of the testing data and methods. While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption under Sections 35(1)(a)&(b) - Law Enforcement of FOISA applies to that information. This is because the release of this information could prejudice the prevention and detection of crime and the apprehension or prosecution of offenders.

This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption. We recognise that there is some public interest in releasing this information however, this is outweighed by the potential consequences to law enforcement and the impact such a release would have on road safety measures.
