Chief Executive Scottish COVID Inquiry in Edinburgh: FOI release

You asked for: 

I would like to request the information (for example analysis of terms of reference, briefings provided to the author(s) of the advert text, any other related Scottish Government documentation that supports (or otherwise) the statements made) that underpins statements in the advertisement - Chief Executive Scottish COVID Inquiry in Edinburgh | Careers at Edinburgh (icims.com) - as follows: 
 

• that the ability of the candidate to influence would be "strongly tested in maintaining positive working relationships with the UK COVID Inquiry" 
• that "the UK Inquiry [is] following a markedly different strategy" 
• that there are "complexities of working productively with the UK Inquiry" - and detailing what those complexities are.

I enclose a copy of some of the information you requested. This is relating to the job description developed by Scottish Covid-19 Inquiry and considered by Scottish Government officials. 

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption(s) under section 38 (1) (b) (personal information) of FOISA applies to that information. The reasons why that exemption applies are explained below. 

An exemption under section(s) 38(1)(b) (personal information) of FOISA applies to some of the information you have requested. This is because the information requested contains personal data of a third party, i.e. the names, contact details and e-mail addresses of individuals, and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. 

This exemption is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
