THE TOWN AND COUNTRY PLANNING (LIMIT OF ANNUAL VALUE) (SCOTLAND) ORDER 2005
Introduction
1. This Circular explains the provisions of the Town and Country Planning (Limit of Annual Value) (Scotland) Order 2005. The Order was made on 23 November 2005 and comes into force on 19 December 2005.
2. A copy of the Order is enclosed for planning authorities only.
Background
3.The 2005 Order prescribes £28,000 as the annual value of hereditament for the purpose of sections 100-122 of the Town and Country Planning (Scotland) Act 1997. Under those sections, owner-occupiers can, in certain circumstances, require the appropriate authority to purchase their interest in property provided that, in the case of a non-resident owner-occupier, the annual value of the non-domestic property does not exceed the prescribed amount.
4.The Town and Country Planning (Limit of Annual Value) (Scotland) Order 2001 which prescribed a limit of £24,725 is revoked. This Circular supersedes SEDD 4/2001 which accompanied the 2001 Order.
