The Civic Government (Scotland) Act 1982 (Licensing of Short-term Lets) (Amendment) Order 2024 Impact Assessments

The Civic Government (Scotland) Act 1982 (Licensing of Short-term Lets) Order 2022 requires local authorities to establish a short-term lets licensing scheme. The 2024 Order includes provisions which have a practical effect on the licensing scheme.


5. Data Protection Impact Assessment (DPIA)

The development of the 2024 Amendment Order and discussion with stakeholders about the included provisions has not raised data protection issues.

It is our view that the new provisions and powers in the 2024 Amendment Order do not raise any data protection issues as no new personal data will be collected other than the personal data already collected as part of the Short-Term Lets Licensing Scheme.

As part of the Data Protection Impact Assessment (DPIA) undertaken for the licensing scheme in December 2020, the Scottish Government committed to reviewing the DPIA on a regular basis: https://www.gov.scot/publications/short-term-lets-licensing-scheme-planning-control-areas-consultation-analysis/pages/12/.

A review of the DPIA is due and as such, the review will now include the new provisions and powers granted through the 2024 Amendment Order. An updated review is set out below:
