Information request and response under the Environmental Information (Scotland) Regulations 2004.

Information requested

Following the site visit for the above development appeal on 19th. April 2023, the Reporter Ms Callan stated that interested parties could make representations re matters that arose from the site visit, but she did not state a date for responses. I would appreciate if you could please confirm the required date for submissions. I note that the document "Comments on Representations" received in 8th April 2023 has not been published. As one of the 'interested parties' who has made a representation I would like to request a copy of this document.

Response

I enclose a copy of the information you requested. The answer to your question in terms of the Reporter accepting a further representation following the site inspection was addressed by Specialised Caseworker, Anastasia Pseiraki in her e-mail dated 24 April 2023.

An exception under regulation 11(2) of the EIRs (personal information) applies to some of the information within the attached requested document because it is personal data of a third party and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exception is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exception.
