Coronavirus Acts: fifteenth and final report to Scottish Parliament (October 2022)

This is the fifteenth and final two-monthly report on the Coronavirus Acts, in which the Scottish Government sets out the status and operation of the legislation necessary to respond to the coronavirus (COVID-19) pandemic.


1. Introduction

1.1. This report includes information on the operation of the temporary provisions of Part 1 of the first Scottish Act (the Coronavirus (Scotland) Act 2020) and second Scottish Act (the Coronavirus (Scotland) (No.2) Act 2020). It also includes an update on the status of those provisions, and confirmation that Scottish Ministers are satisfied that the status of those provisions at the end of the reporting period is appropriate.

1.2. The report also covers information relating to Scottish Statutory Instruments (SSIs) made by Scottish Ministers where the main purpose relates to coronavirus, excluding those made by Scottish Ministers under the first or second Scottish Act or the UK Act (the Coronavirus Act 2020).

1.3. The UK Act does not set out an equivalent statutory requirement for reporting by the Scottish Government or other Devolved Administrations. However, as with the approach taken to previous reports, the Scottish Government has included information on the temporary and permanent provisions in the UK Act for which the Scottish Parliament gave legislative consent.

1.4 Part 1 of both Scottish Acts expired at the end of 30 September 2022, along with the requirement to report on the status and operation of coronavirus legislation. This is therefore the final statutory report on the operation of the provisions. This report sets out for relevant expired provisions where similar provision is made in the Recovery and Reform Act (Coronavirus (Recovery and Reform) (Scotland) Act 2022[1]) or where saving provision has been made by the Coronavirus (Scotland) Acts (Saving Provision) Regulations 2022[2] or the Town and Country Planning (Miscellaneous Temporary Modifications) (Coronavirus) (Scotland) Regulations 2022[3].
