Information requested

All email correspondence sent (1st August 2021 - date) by Liz Lloyd, Strategic Policy and Political Adviser to the First Minister of Scotland, and mentioning "offshore wind".

I enclose a copy of some of the information you requested below at Annex A .

An exemption under section s38(1)(b) of FOISA applies to some of the information you have requested. This exemptions relates to personal data of third parties e.g. names, email addresses and phone numbers.

These exemptions are not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.

An exemption under Section 28(1) of FOISA applies to some of the information you have requested.

This exempts information from disclosure where disclosure would, or would be likely to, prejudice substantially relations between administrations in the UK (e.g. between Westminster and Holyrood).

The exemption in section 28(1) is subject to the public interest test. This means that, even if the exemption applies, the information must be disclosed unless the public interest in withholding the information outweighs the public interest in disclosing it. We have found that, on balance, the public interest lies in favour of upholding the exemptions.

We recognise that there is a public interest in disclosing information as part of open, transparent and accountable government, and to inform public debate. However, there is a greater public interest in allowing Ministers, Special Advisers and officials a private space within which issues can be discussed.
