  1. All briefings, correspondence, emails, letters, notes of meetings and telephone conversations, since 1 March 2022 between Scottish Government Ministers/Officials/Special Advisors and NHS Highland concerning construction delays, the revised completion date and the revised operational date of the National Treatment Centre, Inverness.
  2. All briefings, correspondence, emails, letters, notes of meetings and telephone conversations, since 1 March 2022 between Scottish Government Ministers/Officials/Special Advisors and contractors concerning construction delays, revised completion dates and revised operational dates of the National Treatment Centre, Inverness.

In response to the first request:

I can confirm that the Scottish Government holds information falling within the scope of your request. All information held that is in scope, with the exception of exempt material, is attached in the Annex to this letter.

Regulation 11(2) – applicant has asked for personal data of a third party

An exception under regulation 11(2) of the EIRs (personal information) applies to some of the information requested because it is personal data of a third party and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exception is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exception.

Additionally, some information contained within the attached documents has been removed as the information is out of the scope of your request.

In response to your second request:

While our aim is to provide information whenever possible, in this instance, an exemption under Regulation 10(4) (a) (Information Not Held) this has been applied. This is because the Scottish Government has not had direct contact with Balfour Beatty regarding the completion date of the National Treatment Centre in Inverness since 1 March 2022 up to and including the date of your request.
