Correspondence with Zero Tolerance: FOI release

Information request and response under the Freedom of Information (Scotland) Act 2002.

Information requested

All communication between Zero Tolerance and Scottish government ministers, special advisers and civil servants relating to the first minister's speech on 29/11/22 to mark Zero Tolerance's 30th anniversary. This should include emails, text, WhatsApp, Signal, Telegram, Messenger or any other electronic messages, as well as handwritten notes and minutes of any phone calls or in-person conversations

Response

We enclose a copy of some of the information you requested. While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption under section 38(1)(b) (personal information) of FOISA applies to that information. The reasons why that exemption applies are explained below.

REASONS FOR NOT PROVIDING INFORMATION

An exemption under section 38(1)(b) (personal information) of FOISA applies to some of the information you have requested. This exemption means the personal data which the disclosure of which would contravene data protection principles is redacted. Personal data includes all information that relates to an individual, and includes identifiers such as name, address, and date of birth.

This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
