Culture sector support needs survey: privacy notice

Information about the culture sector support needs survey which is linked to a commitment in the Programme for Government 2024 to 2025.


Invitation

Representatives of the culture sector have been invited to participate in this survey. 

Before you decide, it is important that you understand why the research is being done and what it would involve for you. Please take time to read this information.

Purpose of the study

This survey is being caried out by researchers in Central Analysis Division in the Scottish Government.

The purpose of this research is to understand what you think needs to change to best meet the needs of the sector going forward. Your views will help us gather valuable insights to inform the scope of a planned review of culture sector support in Scotland.

What will happen

If you agree to participate, you will be asked to complete an online survey that will take approximately 15 minutes.

The survey will include questions about your organisation (if applicable), your experiences of applying for and accessing support and your views on future support needs.

Why we ask for this information

This survey does not require you to provide personal data. However, you may choose to include your name/organisation name and the first part of your postcode in the optional fields. These details will be classed as personal data and subject to UK GDPR.

However, the survey can be completed anonymously. If you choose not to provide your name or postcode, no personal data will be collected, and this privacy notice will not apply.

Any personal data you provide will only be used to help us to understand if we have heard from a variety of individual creative professionals and organisations, across different sub-sectors and locations.

How we use your information

We will summarise your responses into summary tables and charts. We may also include quotes from your response in the final report. Any direct quotes in the report will be anonymised. Your name and contact details will never be published.

The researchers will then write an analysis report with main findings from the responses. This report will be published on the Scottish Government website a few months after the survey closes.

The lawful basis for collecting and using your personal data

Participation in this research is voluntary and you can withdraw at any time. Under data protection law we are required to identify a ‘lawful basis’ from Article 6 of the United Kingdom General Data Protection Regulation (UKGDPR) to process your information. In this case, it is Article 6(1)(e): “performance of a task in the public interest” (commonly referred to as ‘public task’), where that task is set out in law, which here includes the Scotland Act (1998). Policy-related research is a core function of government and this work is therefore a related and foreseeable use of the function or power of the Scottish Government, achievable only through the use of personal data.

How your information is held

Your information will be held on a Microsoft Excel datasheet on a secure, Scottish Government server and will only be accessible to individuals within the Central Analysis Division.

We will treat the information you give in accordance with data protection legislation. All responses will be kept confidential and stored securely, to be used solely for research purposes. A report containing the survey findings will be published by the Scottish Government on their website in 2025.

How long we store your information

The survey data will be stored electronically on the Scottish Government’s electronic Record and Document Management system (eRDM) with access restricted to the internal project team. This will be deleted within 6 months of the final report publication.

Data protection rights

Under data protection legislation you have a number of rights available to you:

  • right to be informed about the use of your data – this is done through this privacy notice
  • right of access, to receive a copy of personal data we hold on you
  • right of rectification, to have verifiably inaccurate data we hold corrected or updated
  • right to object to or restrict our use of your data, where we do not have an obligation to process it
  • rights related to automated decision making – we are not using this data to make decisions about individuals.

Please note that these rights are not absolute, and may be subject to exemptions under the Data Protection Act 2018. Where an exemption is applied to a requested right you will be informed of this.

Complaints 

If you are unhappy with how we have used your data, please contact the Scottish Government’s Data Protection Officer at DataProtectionOfficer@gov.scot. They will look into the concerns you have raised and provide the response.

However, if you are not satisfied with the DPO’s response you also have the right to lodge a complaint about data protection matters with the Information Commissioner's Office. The ICO are the supervisory authority responsible for data protection in the UK.
