Information requested

Debtor applications received by the AiB in respect of the estate of a deceased debtor within the scope of section 5(a) of the Bankruptcy (Scotland) Act 2016. I request that the results be broken down by year.

  1. The number of such applications received by the AiB.
  2. The number of such received applications that were returned or unactioned as being inappropriate.
  3. The number of valid actioned applications - and who acted as trustee in these cases.

Question 1:

  • 2016 – 3 applications received.
  • 2017 – 8 applications received
  • 2018 – 9 applications received
  • 2019 – 6 applications received
  • 2020 – 8 applications received
  • 2021 – 18 applications received
  • 2022 – 14 applications received

Question 3:

Information about bankruptcies in Scotland is published in the public Register of Insolvencies (RoI), which can be accessed free of charge. Information about each bankruptcy is published until one year after the date the trustee of the bankruptcy was discharged.

2016 – 3 valid applications received.
Information about these three bankruptcies is no longer published in the public RoI. As the names of trustees is personal information and personal information is exempt from disclosure under Section 38 of FOISA., I am unable to provide you with information about the trustees appointed to act in these three bankruptcies.

2017 – 8 valid applications received
Information about 2 of these bankruptcies is published in the RoI, so I can inform you that the trustees for these two bankruptcies are:

  • Maureen Leslie (MLM), who was replaced by Julie Swan (SKSi) in 2021, who was replaced by Scott Bastick (SKSi) in 2022.
