Development plan amendment regulations: consultation response summary

Summary of responses to our consultation related to proposals for regulations on the processes for amending the Development Plan. This report provides a summary of common themes submitted to this consultation and some key points raised.

To what extent do you agree that an authority should not be required to have regard to the self-build list for every amendment to a LDP?

There were 40 responses to Question 17A, which have been set out by respondent type in Table 17 below.

While most supported the approach towards self-build lists (a combined 67.5%), there were some who were neutral. Only two respondents disagreed.

27 respondents provided further comment at Question 17B.

Summary /Themes

Almost all of the respondents who provided further comment did so to share support for the proposal which, alongside the views of those who were neutral, indicated that the relevance of a self-build list was entirely dependant upon the nature of the amendment.

While no clear theme emerged from the comments provided, one response did agree on the basis that they would expect the LDP guidance to be updated to reflect those situations where the Scottish Government would consider the self-build list to be relevant and therefore taken into consideration during an amendment.

Both respondents who disagreed provided further comment, suggesting that adding a requirement to 'have regard' to the self-build list when preparing an amendment would be proportionate, not particularly onerous and would ensure the opportunity to incorporate the self-build list where relevant.
