Development plan amendment regulations: consultation response summary

Summary of responses to our consultation related to proposals for regulations on the processes for amending the Development Plan. This report provides a summary of common themes submitted to this consultation and some key points raised.

To what extent do you agree with our approach to the impact assessments for the proposed regulations?

There were 37 responses to Question 25A, which have been set out by respondent type in Table 25 below.

Most (a combined 64.9%) were supportive of the approach taken to the relevant impact assessments, however there were some who responded neutrally. Only a single respondent opposed with the approach taken and that came from an individual representation.

23 respondents provided further comment at Question 25B.

Summary /Themes

Almost all of those who responded to 25B were comments supporting the approach taken towards the impact assessments, with only 2 further comments coming from those who were neutral. The respondent who disagreed did not provide comments as to why.

The consensus across the respondents was that this was ultimately for the Scottish Government to decide, however with the agreement that the proposals seem appropriate and proportionate.

The only theme arising throughout the responses to 25B was around a call for further guidance to advise on the consideration amendments need to have to the impact assessments originally carried out for a LDP.

In addition to comments around the Impact Assessments of the proposed regulations, there were a few suggestions that the regulations should set out further requirements for Impact Assessments to be carried out for an amendment.
