The Disability Assistance (Scottish Adult Disability Living Allowance) Regulations 2025: data protection impact assessment

This impact assessment records how data will be used in relation to the Disability Assistance (Scottish Adult Disability Living Allowance) Regulations 2025 and how that use is compliant with data protection legislation.


Background

These Regulations make provision to establish Scottish Adult Disability Living Allowance, which will be delivered by Social Security Scotland on behalf of Scottish Ministers and will replace Disability Living Allowance for adults in Scotland. Disability Living Allowance for adults in Scotland is currently delivered by the Department for Work and Pensions on behalf of Scottish Ministers under an agency agreement. The Regulations also make provision to transfer the entitlement for adults in receipt of Disability Living Allowance in Scotland onto Scottish Adult Disability Living Allowance, and to allow some individuals with an award of Scottish Adult Disability Living Allowance to make an application for Adult Disability Payment.

This Data Protection Impact Assessment (DPIA) works in conjunction with the Article 36(4) ICO consultation form submitted in advance of this, as the proposal requires consultation with the Information Commissioner’s Office (ICO).
