Disposal of productions used in prosecution of Luke Mitchell: FOI release

Information request and response under the Freedom of Information (Scotland) Act 2002.


Information requested

All information held by the Scottish Government legal directorate (e.g., correspondence with Police Scotland, the Crown Office, or the Scottish Police Authority) related to the disposal/potential disposal of productions used in the prosecution of Luke Mitchell (HMA v Luke Mitchell, 2005). This request relates to the time period from January 1, 2021, to the date of responding to this request. The information I would like includes (but is not be restricted to) information related to an initial decision to dispose of productions in the case, and a subsequent decision to halt the disposal of productions.

Response

I enclose a copy of some of the information you requested, attached to this letter as noted in Annex A.

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because exemptions under sections 30(c) and 36(1) of FOISA apply to some of that information. In addition, personal information in the form of names, email addresses and direct telephone numbers have been redacted as exempt under section 38(1)(b) of FOISA.

The reasons why these exemptions apply are explained in Annex B to this letter.
