Information requested
Please may I request an up to date list of contractors, subcontractors and suppliers that have or will be involved with the A9 dualling perth to inverness.
Response
It might be helpful to note that we have already provided some of the requested information on 19 February 2024 (case ref 202400394779). Please see the below link to our previous response: Subcontractors, suppliers and consultants involved A9 dualling project: EIR release - gov.scot (www.gov.scot)
Under regulation 6(1)(b) of the EIRs, we do not have to give you information which is already publicly available and easily accessible to you in another form or format.
While our aim is to provide information whenever possible, in this instance Transport Scotland does not have some of the information you have requested. We do not hold this information as not all of the sections of the A9 Dualling scheme are in construction or have been put out for tender. Under the terms of the exception at regulation 10(4)(a) of the EIRs (information not held), Transport Scotland is not required to provide information which it does not have.
This exemption is subject to the ‘public interest test’. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption. While we recognise there may be some public interest in who will be involved in construction on the A9 Dualling project, clearly we cannot provide information which we do not hold.
It should also be noted that not all of the contractors, subcontractors and consultants listed will have active contracts with Transport Scotland or its contractors/ technical advisors.
Please see below a list of those additional contractors, subcontractors and consultants for the A9 Dualling Programme since 19 February 2024;
A9 Dualling Programme: Tomatin to Moy
To note, at the date of your request, 18 July 2024, name of contractor was subject to completion of the mandatory standstill period. The contract has subsequently been awarded following successful completion of the standstill period.
