AO - section 4.8 AU & AUP – section 4.6 The vessel to which this licence, relates whilst using mobile gear must use a minimum mesh size of 120mm in all waters of sea area IV, bar activity in mud areas/nephrop areas. There are eight defined mud/nephrops areas within the 120mm zone which are exempt on the basis that mud areas are primarily nephrops grounds. In these areas it is permitted to use gear less than 120mm. Vessels using gear that is not designed to come into contact with the bottom, and are fishing for herring, mackerel, horse mackerel or sprats are derogated from the above compulsory measures. Important change to your authority to fish from 23:01 hrs (GMT) on 31 December 2020 UK vessels will be prohibited from fishing in EU, Norwegian or Faroese waters unless the necessary international agreements are reached to allow them to do so and they are authorised to do so by the relevant competent authority. Non-UK vessels will be prohibited from fishing in UK waters in the same way, unless they are granted access under such future agreements. This variation, therefore amends UK vessel licences to remove authority to fish outside British fishery limits. General conditions amendment. 1. The authority to fish in EU, Norwegian, Faroes and NEAFC waters is rescinded and all commercial fishing activity outside of the UK EEZ must stop and all fishing gear be removed by 23:00 hours (GMT) on 31 December 2020. 2. Within this licence any reference to an EU Regulation is a reference to that Regulation as it forms part of United Kingdom domestic law by virtue of Section 3 of the European Union (Withdrawal) Act 2018 in accordance with Schedule 8 (1) of that Act. |
