In your email, you requested the following information:

I am interested in the decision to include Fixed Notice Penalties (FPNs) as a penalty for breaching the Health Protection (Coronavirus) (Restrictions) (Scotland) Regulations 2020, and the decisionmaking process behind this.

Please provide copies of any correspondence, notes, briefings or other documentation that refers to this, including information provided to the Scottish Government from the UK and other devolved governments.

Response

While our aim is to provide information whenever possible, in this instance, exemptions under Section 30(b)(ii) (free and frank exchange of views for the purposes of deliberation), Section 36(1) (confidentiality in legal proceedings) and Section 38(1)(b) (personal information of a third party), applies to some of the information requested. The reasons why these exemptions apply are explained in Annex A of this letter.
