Information requested

"All drafts of the report 'The Life Chances of Young People in Scotland' presented to the Scottish Government, and all correspondence relating to the preparation of the report and drafts between: the independent poverty adviser, Scottish ministers, civil servants and special advisers from 1 May 2017 to 3 July 2017 inclusive."

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption under section 38(1)(b) (personal information) of FOISA applies to that information. The reason why this exemption applies is explained in the Annex to this letter.

Section 25(1) - Information otherwise available.

An exemption under section 25(1) of FOISA (Information otherwise available) applies to some of the information requested because the information has already been made available on the Scottish Government website, ie text within drafts which was included within the final report.

This exemption is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.

Section 38(1)(b) – applicant has asked for personal data of a third party An exemption under section 38(1)(b) of FOISA (personal information) applies to some of the information requested because it is the personal data of a third party, ie the names and contact information for officials are their own personal details, and disclosing this information would contravene the data protection principles in Schedule 1 to the Data Protection Act 1998.

This exemption is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
