Information requested

You asked for us to "confirm whether the application for moorings at Etive 3 has yet been advertised. In any event, please could you send through the application and all documents submitted by Dawnfresh, and any correspondence between Dawnfresh and MS in relation to that application. Please may I also receive full information, including correspondence and application documents, concerning the following two applications, as advertised on your public register:" application 06453 and 06445.

The answer to your question: "…confirm whether the application for moorings at Etive 3 has yet been advertised" is that yes the application for moorings at Etive 3 has been advertised. Information confirming placement of the advert is attached in the email response to your request for information (see documents 002 and 002 A).

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exception under regulation 11(2) (Personal data) of the EIRs applies to that information. The reason why that exception applies is explained below.

Regulation 11(2) – personal data

An exception under regulation 11(2) of the EIRs (personal information) applies to some of the information requested because it is personal data of a third party and disclosing it would contravene the data protection principles in Schedule 1 to the Data Protection Act 1998. This exception is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exception.
