Information requested

  1. Any and all recorded information held by the Scottish Government in relation to the "lessons learnt' into the commissioning of solicitors DLA Piper LLP, who were commissioned by the then SFC CEO to report into the governance and procedures of Glasgow Clyde College ("the College") following the suspension of its Principal.

  2. Please advise if this report/review from by the SFC to the then Cabinet Minister Angela Constance relied on the findings of the DLA PIPER investigation?

  3. If not please provide a copy or copies that must have been recorded as substantive evidence from any source that was supplied by SFC to the Scottish Government & Education Minister Angela Constance which gave legal impetus to allow her to order the removal of the then Glasgow Clyde Board of Management in Oct 2015.

Response

1. No such paper on "lessons learnt" was produced. The work was superseded by the Good Governance Task Group. The remit of the Task Group included:

" ... the lessons that can be learned for government and the wider sector from governance difficulties, including from events at Glasgow Clyde, North Glasgow and Coatbridge colleges, taking note of relevant recommendations from the Public Audit Committee."

The reports from that Group were published on 18 March 2016. The Reports include full lessons learned and can be found here: College Good Governance Task Group

2 and 3. While our aim is to provide information whenever possible, in this instance the Scottish Government does not have the information you have requested. However, you may wish to contact the Scottish Funding Council who may be able to help you. The reasons why we don't have the information are explained below.

Reasons for not providing information

The Scottish Government does not have the information.

The Scottish Government does not have the information you have asked for because we do not hold any records on whether the Scottish Funding Councils report relied on the findings of the DLA PIPER investigation. There was no information supplied by the Scottish Funding Council that gave legal impetus in removing of the then Glasgow Clyde Board of Management.

This is a formal notice under section 17(1) of FOISA that the Scottish Government does not have the information you have requested.
