Information requested

• Full details of the competitive process used for the interim engagement of Mr A McKenna who was employed as a IT Contractor, working to or for the Head of Digital Services during the 2015/16 and 2016/17 fiscal years.

• Details of the those who were involvdetails of the those who were involved in the scoring process and daily rate paid to Mr McKenna.

• Copies of all emails between the Head of Digital Services and anyone involved the process or actual award of the assignment.

• Any prior relationship between the Head of Digital Services and Mr McKenna, the nature of any such relationship, how long this existed for, whether it was personal or business related, and if this was declared by the Head of Digital Services prior to the competitive process commencing.

• Details of amount spent on the services of Mr McKenna and how days (and dates) of when Mr McKenna was paid when he was not on site at any Education Scotland building or site.

Response

I have concluded that the original decision should be confirmed, with modifications.

In your review, you ask the number of days and dates when Mr McKenna was paid for not being in an Education Scotland or any other official building anywhere in Scotland. Education Scotland does not have the information you have asked for because we do not keep records of this type.

In terms of the emails you requested, I am re-sending copies of the original emails you were sent, but this time I have inserted the 'Head of Digital' where appropriate to highlight whether he was the email sender, a copy recipient, or the main recipient. I trust that this now answers your question. There is one additional email, dated 12 October 2016, that I located during the course of my review and which is now also attached.

Finally, in your review request, you state that our response around a previous working relationship between Mr McKenna and the Head of Digital Services is possibly incorrect as there is information in the public domain that would indicate that Mr McKenna was at the wedding of the Head of Digital Services and was possibly the Best Man. I am satisfied that we answered this part of your request in full.
