Information requested
I wish to receive a copy of the Risk Assessment applied by Transport Scotland to contractors for litter clearing activities on the National Road Network. If no specific Risk Assessment is applied by TS then I would wish to receive (by electronic means) a copy of the equivalent Risk Assessments applied by the roads operating contractors employed by Transport Scotland and required / approved by Transport Scotland as the Client letting such contracts on behalf of Scottish Ministers.
Response
As you may be aware, Transport Scotland has contracts in place with Operating Companies who maintain the Scottish trunk roads. As you have requested the risk assessments for the entire network, please find the appropriate risk assessments for each Operating Company. We have also included the risk assessments for routes operated under DBFO arrangements.

An exception under regulation 11(2) of the EIRs (personal information) applies to some of the information requested because it is personal data of a third party and disclosing it would contravene the data protection principles in Schedule 1 to the Data Protection Act 1998. This exception is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exception.
