Information requested
- All information contained in communications between Education Scotland and Dumfries and Galloway Council since January 1 2017. You indicated that we could exclude from this list anything to do with individual school inspections outwith the jurisdiction of the Schools (Consultation) Act 2010.
Response
We have provided the information you have requested with the exception of any information which is exempt under section 38(1)(b) and 25(1) of FOISA. The reason why those exemptions apply are explained below.
Also to note that Education Scotland have direct communication with all Education Authorities including Dumfries and Galloway Council on numerous topics including inspection, improvement, curriculum and parental engagement.

Reasons for not providing information
Section 38(1)(b) - personal data of a third party.
An exemption under section 38(1) (b) of FOISA (personal information) applies to some information requested because it is personal data of a third party, e.g. names/contact details of individuals and disclosing it would contravene the data protection principles in Schedule 1 to the Data Protection Act 1998.
This exemption is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
Section 25(1) – information already reasonably accessible.
Section 25 (1) of the Freedom of Information (Scotland) Act 2002 (the Act) exempts information from disclosure where the requester can reasonably obtain the information without making a request for it.
