Date responded: 15 January 2018
Information requested
Please supply statistics relevant to actions taken by Police Scotland, the former regional Scottish Police forces and the Courts with regard to breaches of the provisions of the above legislation (Licensing (Scotland) Act 2005) since commencement.
Response
The answer to your questions is provided in MS Excel tables attached in Annex A.
Please note:
The statistics dealing with recorded crime and court proceedings are not directly comparable as a person may be proceeded against for more than one crime involving more than one victim and there is the possibility that the crime recorded by the police may be altered in the course of judicial proceedings. Also a crime may be recorded by the police in one year and court proceedings concluded in a subsequent year.
The Licensing (Scotland) Act 2005 came into force in September 2009, hence the data has been included from 2010-11 onwards.
Number of people proceeded against under the legislation in 2016-17 financial year will become available on 27th February 2018.
