Information requested

"….environmental information held by Marine Scotland relative to the foreshore area of the town and its environs is provided to us in electronic format." The information requested relates to "…the project I have in mind was the new pipework that connects the Scottish Water foul water pumping network along the foreshore to the Treatment Works at Moss Road, Colgrain to the east of Helensburgh…"

I enclose a copy of most of the information you requested (Annex A, B & C).

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exception under regulation 11(2) (personal data) of the EIRs applies to that information. The reasons why this exception applies are explained below.

Personal data

Regulation 11(2) – personal data:

An exception under regulation 11(2) of the EIRs (personal information) applies to some of the information requested because it is personal data of a third party and disclosing it would contravene the data protection principles in Schedule 1 to the Data Protection Act 1998. This exception is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exception.
