Information requested

1.1  What objective evaluation was carried out by the Scottish government on the supporting information sent to the justice department on 16 February 2017 in regard to the revised scheme submitted in October 2016 by the Association of Commercial Attorneys?

1.2  What parts, if any, of the supporting  information was felt to be inadequate, or lacking in information, and how was this assessed?

1.3   Did any discussions take place between the Scottish government justice department and the Lord President’s Private Office in regard to the supporting information sent on the 16 February 2017 prior to the e-mail sent from Denise Swanson on the 10 May 2017 to the  Association of Commercial Attorneys?

Response 

The answers to your question are:

2.1  The Scottish Government reviewed the proposals submitted on 16 February and considered these in the context of policy intention, impact and provisions in the Law Reform (Miscellaneous Provisions) (Scotland) Act 1990.

2.2  The attached email from Denise Swanson of 10 May 2017 sets out which particular elements of your proposals would require further analysis.  A copy of that email is attached and the relevant text highlighted.

2.3 The proposals submitted on 16 February were forwarded to Lord President’s office that same day.  A draft of the email of 10 May was shared with LPPO prior to it being sent.
