Information request and response under the Freedom of Information (Scotland) Act 2002.
Date received: 3 September 2018
Date responded: 28 September 2018
I enclose a copy of some of the information you requested. I should also clarify in this instance that the National Collections Facility is a term used only to describe a project in development for the National Galleries of Scotland and which does not involve either of the other 2 national collections bodies you note in your request.
While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption under section s.38(1)(b) Personal information, of FOISA applies to that information. The reasons why that exemption applies is explained below.
An exemption applies.
An exemption under section, s.38(1)(b) Personal information of FOISA applies to some of the information you have requested. This relates to personal data, which if disclosed would contravene data protection regulations.
This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
