You asked the Scottish Government to provide all correspondence between the Cabinet Secretary for Finance & the Constitution of the Scottish Government and the Finance & Constitution Committee of the Scottish Parliament during the period from 1 January 2016 to 14 September 2018 that relates to (A) loans or loan facilities or (B) equity investments - proposed or made by the Scottish Government to / in third party organisations (non public sector organisations).

 

 

While our aim is to provide information whenever possible, in this instance we are unable to provide the information you have requested because an exemption under FOISA applies. The reason why this exemption applies is explained below.

 

 

The Cabinet Secretary for Finance, Economy and Fair Work wrote to the Scottish Parliament’s Finance Committee on two occasions during the period from 1 January 2016 to 14 September 2018 concerning loans and equity investments to third-party organisations.

The correspondence relates to loan facilities provided to Ferguson Marine and the letters are dated 24 April 2018 and 27 June 2018.

The contents of the Cabinet Secretary’s correspondence with the Committee is commercially sensitive and its disclosure would (or would be likely to) prejudice substantially the commercial interests of Ferguson Marine (section 33(1)(b) of FOISA applies).
