All papers produced for and examined by the Scottish Government’s Homelessness and Rough Sleeping Action Group.

I enclose a copy of some of the information you requested and to assist have provided a table at Annex A to show where each of the papers originated from, most of which were from HARSAG members, HARSAG working groups and the Scottish Government.

However, most of the information you have requested has been made available through the Homelessness and Rough Sleeping Action Group’s pages of the Scottish Government website at: https://www.gov.scot/groups/homelessness-and-rough-sleeping-action-group/.  Under section 25(1) of FOISA, we do not have to give you information which is already reasonably accessible to you.  You will however find links from the HARSAG reports at the above link to the key papers and publications considered/referenced by the Action Group. 

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because of exemption(s) under section 33(1)(b) as disclosure would (or would be likely to) prejudice substantially the commercial interests of any person or organisation. This relates to document 14 where we have redacted information to which this exemption applies.

Exemption under section 38(1)(b) of FOISA also applies to some of the information you have requested. This exemption applies because it is personal data relating to an identified or identifiable natural person, such as the names (or other identifying information) of officials and other natural persons. Disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
