Information request and response under the Freedom of Information (Scotland) Act 2002.
Information requested
You asked for “the business diary of Liz Lloyd, the First Minister’s chief of staff, along with any expenses claimed to the Scottish Government by Liz Lloyd on the following dates:
• 2 April 2018
• 23 April 2018
• 7 June 2018
• 14 July 2018
• 18 July 2018”
Response
I enclose a copy of Liz Lloyd’s business diary for these dates. While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption under section 38(1)(b) of FOISA applies to that information. The reason why that exemption applies is explained in the Annex to this letter.
On 2 April, Liz Lloyd claimed £9.30 for newspapers.
While our aim is to provide information whenever possible, in this case we are not able to provide all of the information you requested. For 23 April 2018, 7 June 2018, 14 July 2018 and 18 July 2018, the Scottish Government does not have the information you have asked for, because there were no claims made on these dates by Liz Lloyd.
ANNEX
REASONS FOR NOT PROVIDING INFORMATION
The Scottish Government does not have the information
The Scottish Government does not have the information you have asked for because no expenses claims were made on 23 April 2018, 7 June 2018, 14 July 2018 or 18 July 2018.
This is a formal notice under section 17(1) of FOISA that the Scottish Government does not have the information you have requested.
An Exemption applies
An exemption under section 38(1)(b of FOISA applies to some of the information you have requested, because it is the personal data of a third party.
This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
