Minutes of specific meetings with EDF Energy: FOI release

Information requested

You asked for copies of any notes taken, minutes, briefings or any other papers prepared or exchanged with regards to the below meetings between Scottish Government Ministers and representatives of EDF Energy:

• Ivan McKee was lobbied by David Cameron of EDF Energy at the Scottish Council for Development and Industry Annual Forum Dinner on the 25th of April 2019.
• Derek Mackay was lobbied by Matthieu Hue and Matthias Haag at a meeting in the Scottish Parliament on the 19th of December 2018.

I enclose a copy of some of the information you requested.

While our aim is to provide information whenever possible, in this instance the Scottish Government does not have some of the information you have requested. The reasons why we don’t have the information are explained in the Annex to this letter.

Reasons for not providing information - Annex
Section 17(1) of FOISA (information not held) requires the Scottish Government to notify you if it does not have the information you requested. With regards to the meeting on 25 April 2019 between Mr McKee and David Cameron, the Scottish Government does not have the information you have asked for because no notes or briefing are held on this meeting, which took place at a dinner attended by Mr McKee.

With regards to the meeting on 19 December 2018 between Mr Mackay, Matthieu Hue and Matthias Haag, exemptions under sections 33(1)(b) and 38(1)(b) of FOISA applies to some of the information you have requested. Section 33(1)(b) requires the Scottish Government to exempt the release of information that would (or would be likely to) prejudice substantially the commercial interests of any person or organisation. Section 38(1)(b) requires the Scottish Government to exempt the release of information that is the personal data of a third party.
