Information requested
1. How many open positions you have for "inside IR35" workers/contractors? (ie. how many positions are you advertising but so far have not found suitable people to fill)
2. Scottish Government- How many filled "inside IR35" positions do you have? (ie. how many people are working for you with "inside IR35" conditions)
3. Science & Advice for Scottish Agriculture - how many filled "inside IR35" positions do you have? (i.e. how many people are working for you with "inside IR35" conditions)
4. Housing & Regeneration Directorate - how many filled "inside IR35" positions do you have? (i.e. how many people are working for you with "inside IR35" conditions)
5. Rent Service Scotland - how many filled "inside IR35" positions do you have? (i.e. how many people are working for you with "inside IR35" conditions)
Response
Please note that for the purposes of responding to requests under the Freedom of Information (Scotland) Act 2002 (FOISA) the Directorates responsible for the topics you have asked about are all part of the Authority of the Scottish Ministers. Accordingly this response is in answer to all four of your requests as listed above.
1. We do not advertise open positions (inside or outside IR35) for workers/contractors. Where a need arises for a temporary worker to be assigned to a business area to undertake a temporary role, the business area may choose to utilise the appropriate government framework. Workers can then respond to the position should they be advertised by the Framework provider.
2. We do not hold a central record of the number of IR35 assessments undertaken or their outcomes. Assessments are conducted on a case by case basis by individual business areas.
3. Records held by Science & Advice for Scottish Agriculture show that they currently have one person working with them ‘inside IR35’ conditions.
4. Records held by Housing & Regeneration Directorate show that they currently have no positions/people working ‘inside IR35’ conditions.
5. Records held by Rent Service Scotland show that they currently have no positions/people working ‘inside IR35’ conditions.
