Information requested

1. The email of 5th December 2017 sent from Deputy Director within the People Directorate at the Scottish Government to the Detective Chief Superintendent (DCS), Head of Public Protection at Police Scotland, concerning the development of the Scottish Government’s procedure for handling harassment complaints.

2. Minutes or any other recorded information concerning the meeting of 6th December 2017 between these two people mentioned above and also attended by the Chief Superintendent (CS), Local Policing Commander for Edinburgh Division and the Detective Superintendent (DSU)
for Edinburgh Division.

3. The email of 30th January 2018 between the Deputy Director within the People Directorate at the Scottish Government and the DSU for Edinburgh Division.

4. Minutes or any other recorded information concerning the telephone call of 30th January 2018 between the Deputy Director within the People Directorate at the Scottish Government and the DSU for Edinburgh Division.

5. Any emails, minutes from telephone calls between the Deputy Director within the People Directorate at the Scottish Government and the DSU for Edinburgh Division, and any other recorded information pertaining to any of these, on these dates:
18th April 2018; 19th April 2018; 1st August 2018; 2nd August 2018 and 3rd August 2018

Response

1. While our aim is to provide information whenever possible, in this instance the Scottish Government does not have the information you have requested. This is because, having conducted appropriate and proportionate searches for an email of 5 December 2017 that you refer to, the Scottish Government holds no recorded information within the scope of this part of your request. This is a formal notice under section 17(1) of FOISA that the Scottish Government does not have the information that you have requested.

This is because, having conducted reasonable and appropriate searches for recorded information concerning a telephone call of 30 January 2018, the Scottish Government holds no recorded information within the scope of this part of your request.

An exemption under section 38(1)(b) of FOISA applies to some of the information that you have requested. Section 38(1)(b) applies because it is personal data of a third party, for example names of individuals or other personal data and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
