Inspection report of Regius School: FOI release

Information requested

I am making a request under the information request and response under the Freedom of Information (Scotland) Act 2002 relating to information which you hold about the following independent school, Regius School.

I would like any documents held relating to complaints from pupils, staff, parent or any other person related to the school, going as far back as possible.

Furthermore, I would like any document relating to concerns raised from Scottish Government inspections of this school.

Response

We have provided a complaint relating to Regius School at Annex A.

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption under section, 38(1)(b)(personal information) of FOISA applies to that information. The reason why that exemption applies is explained below.

An exemption under section 38(1)(b) of FOISA (personal information) applies to some information which has been redacted from the enclosed document. This exemption applies because the information is personal data of a third party, i.e. names of individuals, and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018.

This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.

Whilst under section 25(1) of FOISA, we do not have to give you information which is already reasonably accessible to you, for convenience we have attached copies of these inspection reports to this correspondence at Annex B - F.
