Information requested
To ask Scottish Ministers to provide all correspondence, emails and reports that specifically relate to the remuneration package to Mr Hair, via his management company, that culminated in his appointment as Turnaround Director on 14th August 2019 by Scottish Ministers. Given Mr Hair's significant remuneration package from the date of his employment please also provide the names of the officials in the appropriate department in the Scottish Government who negotiated this package, and the name of the person who ultimately approved that remuneration package. Please provide all correspondence that relate to the process, as this is in the public interest.
Response
You asked for all correspondence, emails and reports that specifically relate to the remuneration package of Mr Hair. Please find attached the correspondence held on file relating to your request.
You also asked for names of officials who negotiated the remuneration package, and who approved the package. Liz Ditchburn (Former Director-General for Economy) was supportive of the package, whilst Derek Mackay (Former Cabinet Secretary for Finance, Economy and Fair Work) approved the package.
While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption under section 38(1)(b) – personal data of a third party.

REASONS FOR NOT PROVIDING INFORMATION
An exemption applies
An exemption under section 38(1)(b) (personal data of a third party) of FOISA applies to some of the information you have requested. This exemption applies to the names of third parties referenced throughout the documents within scope of the request. The Scottish Government has a policy of not disclosing the names of officials who are not Senior Civil Servants. The names of non-senior civil servants have been redacted to protect their privacy.
This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
