Appointments to BBC Board Scotland Nation Member: FOI release

“Copies of all correspondence, digital and physical, record and notes of meetings regarding appointment to the position of the Scotland Nation Member on the Board of the BBC from August 1 2021 until today - involving at least, but not limited to, the Scottish Government, UK Government, BBC and the Commissioner for Public Appointments.”

Please accept our sincere apologies again for the delay in responding to your request, which came as a result of delays in allocating this request to the appropriate business area over the festive period.

In your request you refer to “correspondence, digital and physical” and we have interpreted this as the letters and emails that have been sent and received by the Scottish Government to/from other organisations, including those you listed, related to the Scotland Nation Member on the Board of the BBC.

I attach a copy of most of the information you requested.

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption under section 38(1)(b) (personal information) of FOISA applies to that information. This exemption is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.

We are also unable to provide some of the information you have requested because exemptions under sections 30(b)(i) and (ii) (prejudice to effective conduct of public affairs) of FOISA apply to this information. The release of this information would inhibit substantially the free and frank provision of advice or the exchange of views for the purposes of the appointment process and would impact negatively on the decision-making processes and the conduct of future recruitment exercises.
