Correspondence regarding Parliamentary Question S6W-09495: EIR release

Information requested

“For any and all correspondence relating the drafting of the PQ [S6W-09495]. Given the decision letter was issued 27/07/22, and the question was submitted 30/06/2022 asking when the decision was made, and itself was answered 15 days prior to the decision, it would be fair to assume that the handling report would focus on the question, not the decision at hand.”

Response

An exception under regulation 11(2) of the EIRs (personal information) applies to some the information requested because it is personal data of a third party and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exception is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exception.

Each written and oral parliamentary question (PQ) is assigned to a relevant official to prepare a draft answer and background note. These are sent to the appropriate Minister’s private office using the online ‘PQ Tracker’ system. I attach a copy of the draft answer and the background note which were provided to Mr Arthur’s private office, in relation to PQ S6W-09495. Also attached is a copy of an email trail regarding the assignment of the PQ.
