Further to my letter of 21 November 2022, I have now completed my review of our response to your request under the Freedom of Information (Scotland) Act 2002 (FOISA) for the minutes, agendas and reports submitted, for the Education Reform Programme Board; the Inspectorate and Agency Delivery Board; Qualifications Body Delivery Board; and the Policy and Legislation Delivery Board.

I have concluded that a different decision should be substituted.

This is because, as stated in your review request, the original response only dealt with one aspect of your request (for the minutes of the Boards) and not their agendas nor reports provided to them. I apologise for the mishandling of your initial request and for the delay in providing a response to your request for review. The latter was due to the significant volume of information in scope.

Response to your review
In conducting my review, I have undertaken further searches to cover all aspects of your request and in doing so I have identified a number of additional documents which would fall within the scope of your request. Having considered these documents, I enclose a copy of most of the inform ation you requested. As this includes information from a large number of papers, across numerous meetings of the three boards, Annex B includes a numbered list of all the papers in scope for reference.

Some of the information you have requested (specifically the membership of the Delivery Boards, which was the subject of one of the Board papers) is available from the Education Reform Programme webpages on the Scottish Government website. www.gov.scot/groups/education-reform.

Under section 25(1) of FOISA, we do not have to give you information which is already reasonably accessible to you. If, however, you do not have internet access to obtain this information from the website(s) listed, then please contact me again and I will send you a paper copy.

In addition, while our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because exemptions under sections: s.29(1)(a) (policy formulation) and s.38(1)(b) (personal information) of FOISA apply to that information. The reasons why those exemptions apply are explained in the Annex to this letter.
