Follow up questions relating to 202200335383: FOI release

Information request and response under the Freedom of Information (Scotland) Act 2002.


Information requested

  1. The full text of the original advertisement as published and available via the link below prior to 21 December 2022.
  2. The full text of the updated advertisement as updated on 21 December 2022
  3. A 'tracked change' comparison of the two above documents to indicate what the comment "A slight change to one of the key responsibilities and one of the essential criteria "Leading and Influencing Others" was changed" as presently on the website refers to.
  4. The communications (of any format) within the Scottish Government and with the recruitment agency for the post (Aspen) that detail the reasoning for the changes and why they were made on 21 December 2022.

Response

I enclose the following:

  • Document 1: the original version of the Candidate Pack for the role (dated 14 December 2022)
  • Document 2: the revised version of the Candidate Pack for the role (dated 21 December 2022)
  • Document 3: a redacted copy of an email exchange dated 21 December 2022 between the Scottish Government and Aspen People regarding the amendments to the Candidate Pack
  • Document 4: a copy of the updated advert from 21 December 2022

As all of the advertising was online, we no longer hold a copy of the original advertisement as published. Nor do we have a ‘tracked change’ comparison of the advertisements.

This is formal notice under section 17(1) of FOISA that the Scottish Government does not have the information you have requested at points one and three.

Whilst our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption under section 38(1)(b) of FOISA applies to some of the information you have requested at point four. This is because personal information such as phone numbers, staff names and email addresses were included in email chains and have been redacted. This exemption applies because it is personal data of a third party, the names/contact details of individuals, and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018.
