Information requested

All items of information held in relation to the briefing prepared for minister Patrick Harvie for his meeting / video conference with the Scottish Association of Landlords on 5 October 2022, and all notes and records of this meeting.

Response

While our aim is to provide information whenever possible, in this instance the Scottish Government does not have some of the information you have requested. The Scottish Government does not have this information because no briefing was prepared for the Minister for Zero Carbon Buildings, Active Travel and Tenants’ Rights for the meeting specified in your request, as the minister was already fully briefed from parliamentary business. This is a formal notice under section 17(1) of FOISA that the Scottish Government does not have the information you requested.

I attach a copy of the remainder of the information you requested. An exemption under section 38(1)(b), the personal data of a third party, of FOISA applies to some of this information. The exemption under section 38(1)(b) is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.

For clarification, please note that while it is not made explicit in the enclosed meeting note, the points made in paragraphs 4-7 reflect only opinions expressed by the Scottish Association of Landlords rather than substantiated facts.
