Correspondence on applying exclusions to Internal Market Act: FOI release

Information request and response under the Freedom of Information (Scotland) Act 2002

Information requested

Under Freedom of Information legislation I would be grateful if I can receive a copy of all correspondence between the Scottish and UK Governments on the process for applying for an exclusion to the UK Internal Market Act since 1 January 2021.

Response

The attached information in Annex B relates to the development and publication of the UK Internal Market Act exclusions process agreed on a four nations basis as part of the Common Frameworks programme.

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because exemptions under section s.29(1)(a) (policy formulation) and s.38(1)(b) (personal information) of FOISA applies to that information. The reasons why these exemptions have been applied are explained in Annex A.
