Information requested

The current number of staff who are suspended from Marine Scotland and on full pay, and how many have been in this situation in the last 5 years?

Response

In your request, you asked for information about members of staff working within Marine Scotland. Our response therefore covers Scottish Government staff employed in the Marine Directorate.

You have asked for information about suspension on full pay. Suspension is only used in line with the ACAS guidance.

As at 30 June 2023, there were fewer than five staff members who had been suspended on full pay in the last 5 years.

An exemption under section 38(1)(b) of FOISA (personal information) applies to some of the information requested because it is personal data of a third party, and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
