Information pertaining to review carried out by Dr Lee Jordan: FOI Review

Information requested

Further to my letter of 23 August 2023, I have now completed my review of our failure to respond to your request under the Freedom of Information (Scotland) Act 2002 (FOISA) for your request: “In the review carried out by Dr Lee Jordan he highlights timeline documentation complied by Audrey Warden. Does the Scottish Government hold this paperwork? If so, would it be available under a FOI request?”

In accordance with section 21(4) of FOISA, I have also reached a decision on your request Please accept my sincere apologies for the delay in responding to your FOI request. Due to thesensitive nature of some of the information you requested, and that some of the information was originally held in a different organisation, it took a substantial amount of time to collate and prepare the materials. I can now provide our response to your original request.

Response

I enclose a copy of most of the information you requested; this is attached at Annex A.

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption under section 38(1)(b) (personal data relating to a third party) of FOISA applies to that information. This exemption applies because the information you have requested is considered to be personal data relating to an individual’s private life, rather than their public duties, or because the individual is not working in a senior position. It is therefore not able to be released under a FOISA request.
