Information requested

Regarding the response to the request 202300364114, please provide all diary invitations sent that facilitate the "ongoing pre-launch activity" per the response at point 3 including the recipients and their titles". In your review request you also note that "I was requesting all diary invitations sent that facilitate the "ongoing pre-launch activity", i.e. the meeting or setting where such a decision or question would be had.

Response

Further to my letter of 29 August 2023, I have now completed my review of our response to your request under the Freedom of Information (Scotland) Act 2002 (FOISA) in which you asked "Regarding the response to the request 202300364114, please provide all diary invitations sent that facilitate the "ongoing pre-launch activity" per the response at point 3 including the recipients and their titles". In your review request you also note that "I was requesting all diary invitations sent that facilitate the "ongoing pre-launch activity", i.e. the meeting or setting where such a decision or question would be had".

I have concluded that a different decision should be substituted.

The meeting which facilitated the decision to remove the 8-10 week timescale was part of a broader series of re-occurring weekly meetings. When the meeting was no longer necessary, its occurrence was deleted to create diary space. As a feature of our email platform, the deletion also resulted in the diary slot being removed for past meetings. It was therefore determined that the information was not held, as the search did not identify which specific meeting facilitated the decision.

While the diary invitation was removed from calendars and inboxes, it was discovered during the review that the original invite which started the meetings regular occurrence was shared to colleagues on another platform. While this is not in diary invite format, it contains the information of your request. The response to your previous request was not a deliberate misinterpretation of your question, but we
apologise, as this information should have been found and shared with you.

The invite to the meeting which started its regular occurrence was sent on 25 August 2021. The following is the list of delegates initially invited.

Please note however, the discussion around the 8-10 week timescale took place on 22 March 2022. Therefore, the list of people who attended on 22 March 2022, would likely be different from those originally invited on 25 August 2021. Please also note that the titles are accurate as of 05 September 2023, but may have been different at the time of the meeting.

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption under section s.38(1)(b) of FOISA applies to that information. The reason why that exemption applies is because it relates to personal information.

This exemption is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
