Information request and response under the Freedom of Information (Scotland) Act 2002


Information requested

In May the Scottish Government committed to holding a summit on tackling violence in schools; the summit took place yesterday on Tuesday 5 September. Could you please provide me with any information held in terms of

  • the list of attendees;
  • the minutes from the summit;
  • any papers provided to attendees ahead of the summit/during the summit.

I enclose the following information in response to your request.

List of attendees:
A list of attendees is enclosed. While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption applies under section 38(1)(b) – personal information.

This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption. For the exemption under section 38(1)(b), we recognise there is some public interest in release to clarify who attended. However, this is outweighed by the public interest in ensuring the Scottish Government fulfils its requirements under the Data Protection Act.

The minutes of the summit:
While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption applies under section 27(1) – information intended for future publication. It is intended that a note of the summit will be placed on the Scottish Government website within the next 12 weeks.

This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption. For the exemption under section 27(1), we recognise there is some public interest in release to clarify what was discussed. However, this is outweighed by the public interest in ensuring the Scottish Government remains open and transparent by publishing a note of the summit in due course.

I have enclosed a copy of the agenda and table discussion questions.
