Information requested
“The Scottish Government website where the minutes of meetings of the Scottish Education Council (SEC) are published only has minutes up to February 2023. Could you please provide me with the minutes for any meetings that have taken place since February 2023? In your response could you please include any papers or reports provided to members of the SEC ahead of their meetings? Please do not include any reports or papers that are more than a year old.”
Response
There has only been one Scottish Education Council meeting since February 2023 which took place on 27 April. The minutes of that meeting are available here: Scottish Education Council minutes: 27 April 2023 - gov.scot (www.gov.scot). Under section 25(1) of FOISA, we do not have to give you information which is already reasonably accessible to you.
In addition, I have also attached the April meeting papers as separate PDFs. While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption s.38(1)(b) (personal information) of FOISA applies to that information. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
