Response

I have now completed my review of our response to your request under the Freedom of Information (Scotland) Act 2002 (FOISA).

You expressed you were not satisfied with our reply to your original Freedom of Information (FoI) request which was allocated reference number 202300374529 asking for:

What is Project Sakura please? Please provide me with project outlines, aims, targets and actions and the cost of this project in its entirety please.

I have been asked to look at your request afresh, to decide whether the original response should be confirmed with or without modifications as appropriate, or that a fresh decision should be substituted. I can confirm that I was not involved in the handling or decision-making around the original response. I have considered this case again, and I have conducted a comprehensive review of the response, and the reasons behind withholding the requested information. I have concluded that the original decision should be upheld with modifications and as such some additional information contained within the documents held in scope has now been released.

I am satisfied that some information you have requested remains exempt from disclosure under section 30(c) (effective conduct of public affairs) and section 38(1)(b) (personal data) of FOISA for the reasons set out in the annex to this letter. In addition, I have concluded that an exemption under section 36(1) (legal advice) would apply to a small amount of the information you have requested. The reason why this exemption would apply is set out in the annex to this letter.

I have also determined that the Scottish Government does not have the information you have requested in relation to the cost of the project in its entirety.

The Scottish Government does not have the information you have asked for because Project Sakura is currently ongoing. This is a formal notice under section 17(1) of FOISA that the Scottish Government does not have the cost information you have requested.

I have also reviewed the information which was marked as falling out with the scope of your request and I am satisfied that this is correct. The information does not set out what Project Sakura is, nor does it detail project outlines, aims, targets and actions or the cost of this project in its entirety please. We are not therefore required to provide this information.
